<p>Class Definition</p> <p>GENERAL STATEMENT OF DUTIES: In the Department of Labor and Training (DLT), to serve as lead investigator in the examination and enforcement of compliance with labor standards laws and state prevailing wage laws including but not limited to Minimum Wages and Hours, Payment and Collection of Wages, Child Labor, Industrial Job Shops, Public Works Construction Projects, the Rhode Island Parental Family and Medical Leave Act, Paid Sick and Safe Leave, Employee Misclassification, OSHA 10 Compliance, Historic Tax Credits and Apprenticeship Requirements; to prepare cases for DLT administrative hearing or court presentation; to appear at hearings or court to provide testimony; to prepare compliance material and provide training to the public, awarding authorities, contractors, and other interested groups; to develop contacts/liaison with other agencies; and to do related work as required.</p> <p>SUPERVISION RECEIVED: Works under the general supervision of a superior from whom general instructions are received with considerable latitude for the exercise of independent judgment in completing assignments; work is usually reviewed upon completion for conformance with laws, rules, policies, procedures, and objectives.</p> <p>SUPERVISION EXERCISED: As assigned, may train, instruct and guide new investigators in the proper completion of assignments and the law, rules, policies, and procedures utilized, and may supervise clerical and administrative staff as required.</p> <p>Illustrative Examples of Work Performed</p> <ul> <li> <p>In the Department of Labor and Training (DLT), to serve as lead investigator in the examination and enforcement of compliance with labor standards laws and state prevailing wage laws including but not limited to Minimum Wages and Hours, Payment and Collection of Wages, Child Labor, Industrial Job Shops, Public Works Construction Projects, the Rhode Island Parental Family and Medical Leave Act, Paid Sick and Safe Leave, Employee Misclassification, OSHA 10 Compliance, Historic Tax Credits and Apprenticeship Requirements.</p> </li><li> <p>To prepare cases for DLT administrative hearing or court presentation.</p> </li><li> <p>To appear at hearings or court to provide testimony.</p> </li><li> <p>To prepare compliance material and provide training to the public, awarding authorities, contractors, and other interested groups.</p> </li><li> <p>To develop and maintain contacts and liaison with other agencies.</p> </li><li> <p>To serve as lead investigator on complex investigations and, as assigned, to oversee the work of other investigators.</p> </li><li> <p>To testify under oath in Administrative Hearings and judicial proceedings regarding investigative findings, and to defend those findings under cross-examination.</p> </li><li> <p>To collect and evaluate a variety of evidence, from basic to the most complex, and make a determination regarding the validity of wage complaints.</p> </li><li> <p>To conduct extensive in-depth investigations of employers' payroll and other records concerning labor law compliance.</p> </li><li> <p>To conduct in-person interviews and collect relevant evidence on job sites that include employers that promote the Underground Economy.</p> </li><li> <p>To encourage workers that are employed as part of the Underground Economy to provide statements and offer testimony to combat employee misclassification.</p> </li><li> <p>To negotiate basic and complex matters with employers, their legal counsel, accountants and other representatives in order to obtain voluntary compliance and collect back wages for employees.</p> </li><li> <p>To prepare detailed investigation and other reports including details on the procedures followed, the substantiation of data and a summary of findings and recommendations.</p> </li><li> <p>To prepare and file claims against the applicable contractor's bond for any potential prevailing wage violations.</p> </li><li> <p>To prepare Employee Misclassification violations for administrative hearings and to give testimony.</p> </li><li> <p>To track and prepare quarterly summary reports of employee misclassification violations and provide findings to the Assistant Director of Workforce Regulation & Safety or other members of DLT management as directed.</p> </li><li> <p>To develop and maintain strong connections with a variety of agencies and organizations including the Department of Revenue, Unemployment, Contractors Registration Board, Attorney General and Department of Public Safety regarding Employee Misclassification.</p> </li><li> <p>To serve as advisory on Contractor Bond interrogatories produced during an investigation.</p> </li><li> <p>To promote an effective public relations program involving providing information to employers, employees, public officials and representatives of local, state and federal agencies regarding the interpretation of Prevailing Wage and OSHA-10 laws as well as objectives of the department.</p> </li><li> <p>As assigned, to train, instruct and coach new investigators in the proper completion of assignments and the law, rules, policies, and procedures utilized; to supervise clerical and administrative staff as required.</p> </li><li> <p>To do related work as required.</p> </li></ul> <p>Required Qualifications for Appointment</p> <p>KNOWLEDGE, SKILLS AND CAPACITIES: A thorough knowledge of the principles, techniques and methods of labor law compliance, investigations, inspections and audits; knowledge of labor laws relating to employment and the ability to explain and interpret pertinent provisions of laws and regulations; knowledge of accounting practices; the ability to ascertain facts by personal contact and observation and the examination of records; knowledge of court procedures; the ability to detect violations of various labor laws and to gain compliance with these laws; the ability to prepare clear and concise analytical reports; the ability to establish and maintain effective working relationships with the public, employers and their representatives; the ability to serve as the lead investigator on complex investigations; the ability to communicate clearly and effectively both verbally and in writing; and related capacities and abilities.</p> <p>EDUCATION AND EXPERIENCE:</p> <p>Education: Graduation from a college of recognized standing with a bachelor's degree in in Criminal Justice, Law Enforcement, Accounting, Business Administration, or a closely related field; and</p> <p>Experience: A minimum of three (3) years of employment in investigatory, accounting and auditing work which involves obtaining technical facts, interviewing employees, gathering evidence, writing reports, filing claims against bonds, reviewing OSHA-10 Certifications, and conducting employee misclassification tests.</p> <p>Or, graduation from a college of recognized standing with an associate's degree in Criminal Justice, Law Enforcement, Accounting, Business Administration, or a closely related field and a minimum of five (5) years of employment in investigatory, accounting and auditing work which involves obtaining technical facts, interviewing employees, gathering evidence, writing reports, filing claims against bonds, reviewing OSHA-10 Certifications, and conducting employee misclassification tests.</p> <p>SPECIAL REQUIREMENT: At time of appointment, must possess an OSHA 30-hour certification and must maintain such certification as a condition of employment.</p> <p>For information regarding the benefits available to State of Rhode Island employees, please visit the Office of Employee Benefits' website at http://www.employeebenefits.ri.gov/.</p> <p>Also, be advised that a new provision in RI General Law 35-6-1 was enacted requiring direct deposit for all employees. Specific to new hires, the law requires that all employees hired after September 30, 2014 participate in direct deposit. Accordingly, any employee hired after this date will be required to participate in the direct deposit system.
