<p>The Counsel, Capital Projects will provide advice and counsel on behalf of the Office of the General Counsel within the Commercial Transactions Center of Excellence. The Counsel, Capital Projects is accountable for delivering excellent legal services to advance the delivery of the MBTA's capital program including procurement, design, and construction</p> <ul> <li>Provide legal advice to MBTA staff concerning procurement and contract matters, interagency matters. </li><li>Provide legal advice and support to design and construction procurements and projects including contract and legal interpretation and claims and conflict of interest matters. </li><li>Provide legal advice and support on pending construction claims on capital programs projects. </li><li>Draft, negotiate, review, and finalize professional services, construction, and other contracts. </li><li>Provide legal advice concerning MBTA projects, Transit Oriented Development (TOD) projects, and other initiatives to support economic development, affordable housing, access to transportation, public improvement, and diversity. </li><li>Oversee the work of outside legal counsel to represent MBTA during procurements and contract delivery. </li><li>Prepare summaries of complex transactions for the General Counsel's Office, the General Manager's Office, the Secretary, the Board of Directors, and senior management. </li><li>Ensure compliance with applicable laws, including federal and state procurement laws and regulations. </li><li>Ensure compliance with MBTA policies and processes. </li><li>Review and approve documents and agreements prior to approval as to form by the Office of General Counsel and execution. </li><li>Interpret court decisions and opinions, statutes, rules, and regulations applicable to the MBTA. </li><li>Review and provide advice on contract administration, disputes, and interpretations. </li><li>Perform legal research as required on issues relative to commercial transactions within Capital Programs. </li><li>Perform all other duties and projects that may be assigned. </li></ul> <p>Additional responsibilities may include a focus on one or more departments or locations. See applicable addendum for department or location-specific functions. </p> <ul> <li>Juris Doctorate Degree from an accredited institution. </li><li>Membership in good standing of the Massachusetts Bar with annual certification and registration by the Board of Bar Overseers. </li><li>Five (5) years of legal experience, including public contracting or construction or real estate development projects. </li><li>Excellent communication skills. </li><li>Ability to manage multiple stakeholders in a fast-paced work environment. </li><li>Effective organizational, analytical, confidentiality, quantitative, writing, multi-tasking, and time management skills. </li><li>Proficient with the use of MS Office applications. </li><li>Demonstrated ability to communicate and present effectively to a diverse group of stakeholders and customers. </li><li>Have the ability to work effectively with a diverse workforce. </li></ul>
