<p>Managing County Attorney</p> <p>Employment Type: 0 - Full-time Regular</p> <p>Pay Range: $139,002.00 - 208,502.00</p> <p>Location: Castle Rock, CO</p> <p>Overtime Exempt: Y</p> <p>Elected Office / Department: COUNTY ATTORNEY</p> <p>This is highly responsible complex legal work providing legal advice and representation to various Departments of Douglas County Government.</p> <p>Generally, the hiring range is $139,002-$173,752 annually. For a more detailed overview please view the full Employee Benefit Guide.</p> <p>ESSENTIAL DUTIES AND RESPONSIBILITIES: (The following examples are illustrative only and are not intended to be all inclusive.)</p> <ul> <li> <p>Provides day-to-day legal advice and representation to County Department heads and staff in transactional, operational, and land use matters. Prepares and reviews drafts of contracts, agreements, and other legal documents. Provides legal oversight in land use matters. Reviews records for release under CORA. Ensures legal aspects of County operations and land use regulatory process used by the County are in compliance with all state and federal rules and laws. Represent the County in land use court proceedings when needed.</p> </li><li> <p>When supporting the Human Services Department will provide legal advice and representation regarding Dependency and Neglect (D&N) cases. Tries cases in state and federal court. Handles all stages of D&N or child welfare matters, including but not limited to emergency protection or removal orders, filing of the petition, represent the Department at emergency hearings, review hearings, trials, and proceedings for termination of parental rights. Prepares and reviews drafts of contracts, petitions, appeals, guardianships and grant applications. Provides legal oversight in adoption hearings and subsidy appeals. Prepares cases for review by the Administrative Courts for appeals of child abuse findings. Review records for release. Ensure legal aspects of child welfare cases are in compliance with all state and federal rules and laws including but not limited to: ASFA, Families First, Title IVE, ICWA, HIPAA, FERPA, IDEA, Federal law Title 42 regarding substance abuse treatment related information, and Colorado law regarding confidentiality and privilege. Represents the County in delinquency court proceedings when needed. Reviews Memorandums of Understandings. Serves in a legal advisor capacity for the Douglas County Child Protection Teams and the Citizens Review Team when needed.</p> </li><li> <p>Prepares legal opinions of routine nature for the County and provide legal advice and counsel to the Douglas County Attorney and various Department Directors and staff. As needed attends work sessions and various other meetings to advise regarding legal problems and questions. Represents the County in meetings, negotiations, in court, and in the legislature as needed.</p> </li><li> <p>Interprets legal documents, rules and legislation and represents the County in legal actions. Provide status reports to the County Attorney and Department Directors on litigation matters and other important related legal matters.</p> </li><li> <p>Interpret laws, rulings, and regulations for assigned elected official, department head or law enforcement agencies. Confers with colleagues with specialty in these practice areas to establish and verify any basis for legal proceedings.</p> </li><li> <p>Conducts legal research, interviews County Officers, employees, and witnesses, and handles other matters. Prepare legal briefs; develop strategy, arguments and testimony in preparation for presentation of case.</p> </li><li> <p>Prepares County staff for testimony in civil, administrative and domestic court proceedings.</p> </li><li> <p>Provides legal advice and memoranda on legal questions to elected officials, department and division heads, and employees.</p> </li><li> <p>Provides legal training as necessary and appropriate to County Attorney staff and other Departments.</p> </li><li> <p>Reviews a variety of issues for compliance/ability to comply with state and federal requirements.</p> </li><li> <p>Coordinate issues between various County Departments and other jurisdictions and their counsel.</p> </li><li> <p>Must maintain a degree of skill in the practice of law that allows for competent and detailed legal advice with minimal support and no immediate oversight and independent judgment and decision making ability is crucial to success.</p> </li><li> <p>Prepares legal opinions of routine nature for the County and provide legal advice and counsel to the Douglas County Attorney and the County Director and staff. Attends work sessions and various other meetings to advise regarding legal problems and questions. Represents the County in meetings, negotiations, in court, and in the legislature.</p> </li><li> <p>Supervises Assistant County Attorneys and Senior Assistant County Attorneys in the performance of County Attorney Office operations, including the responsibility of hiring, establishing performance expectations, assigns work, reviewing performance, managing disciplinary processes when needed including terminations.</p> </li><li> <p>Performs other duties as assigned.</p> </li></ul> <p>SUPERVISION RECEIVED: This position reports to a Deputy County Attorney in the County Attorney's Office.</p> <p>SUPERVISORY RESPONSIBILITIES: This position has direct supervisory responsibilities of staff including Paralegals and/or County Attorneys. Will review work prepared by County Attorney and other County Department staff.</p> <p>CONSEQUENCE OF ERROR: This is highly responsible complex legal work. Consequence of error may result in significant legal liability for the County or inability of elected officials and other County employees to effectively and legitimately perform their jobs.</p> <p>CONTACTS: This position has substantial contact with various County Department employees, court officials, other attorneys, the public, with County Elected Officials.</p> <p>INDEPENDENT JUDGMENT: Work involves a high degree of independent judgment based on knowledge of the law and past experience.</p> <p>MINIMUM QUALIFICATIONS:</p> <p>EDUCATION and/or EXPERIENCE:</p> <ul> <li>Graduation from an accredited law school with an LL.B. /J.D. degree. </li><li>At least eight (8) years of law practice with litigation required, and some management or supervisory experience. </li><li>Experience managing a legal team is strongly preferred. Experience working with vulnerable populations, special victims units, child welfare, dependency and neglect cases, family law, law enforcement, contracts, land use or other County or public sector related experience is beneficial. </li></ul> <p>KNOWLEDGE, SKILLS, AND ABILITIES:</p> <p>Knowledge:</p> <ul> <li>Knowledge of Colorado land use law, Colorado Open Records Act, and contract law. </li><li>Knowledge of civil, domestic and criminal law, court procedures, the Children's Code, Colorado Code of Regulations and rules of evidence. </li><li>Considerable knowledge of state statutes and appellate decisions. </li><li>Considerable knowledge of principles, methods, practices, and materials utilized in legal research and writing. </li><li>Management practices and principles. </li><li>Strong leadership capabilities to assist, guide and coach the team to offer solutions/alternatives that address complex issues. </li></ul> <p>Skills:</p> <ul> <li>Skill in the preparation and trial of lawsuits and/or legal transactional work. </li><li>Gather, analyze, and evaluate complex facts and law. </li><li>Communicate effectively in both oral and written form. </li><li>Present ideas clearly and concisely. </li></ul> <p>Abilities:</p> <ul> <li>Ability to read statutes, analyze and interpret court decisions, legal procedures, documents, statutes, and regulations. </li><li>Ability to prepare complex legal documents, opinions, pleadings, and briefs. </li><li>Ability to communicate effectively in both oral and written form. </li><li>Ability to establish and maintain effective working relationships. </li><li>Ability to gather, analyze, and evaluate complex facts and law. </li></ul> <p>CERTIFICATIONS, LICENSES, & REGISTRATIONS:</p> <ul> <li>Must be admitted by the Colorado Supreme Court to practice law in the State of Colorado and other jurisdictions where relevant cases may be filed. </li><li>Must possess a valid Colorado Driver's License upon hire, with complying insurance. Review of motor vehicle record is required at time of hire and periodically throughout employment. </li><li>This position requires successful completion of a criminal background check including fingerprinting through a national database. </li></ul> <p>WORK ENVIRONMENT: Work is generally performed in a typical but busy office or courtroom environment. Work may involve travel outside of Douglas County and includes evening and weekend work. This position requires the incumbent to remain available via mobile cellular device/email access during and after normally scheduled business hours. This may mean being available to perform additional duties and hours beyond what is normally required. In the event that an exempt employee does work more than 40 hours a week in support of County operations during an emergency, such employee may receive overtime or other appropriate wage compensation in accordance with existing County policies or at the discretion of the County.</p>
