Together this team supports Orange County¿s needs by managing all real estate functions in support of public infrastructure, capital improvements, and community development initiatives. A Senior Title Examiner on the Development Team is responsible for performing complex title examinations, drafting instruments of conveyance and agreements associated with the acquisition and/or disposition of real property, and reviewing/mapping metes and bounds legal descriptions. The ideal candidate will have demonstrated success in commercial real estate title examination, title insurance closings, and strong attention to detail.</p> <p>Job Description</p> <p>General Functions:</p> <p>Performs complex technical work in the review and examination of title, legal documents, legal descriptions and addresses any encumbrances and/or title defects to ensure the acquisition of clear and marketable title.</p> <p>This position routinely exercises independent judgment in all aspects of the position, including but not limited to approval of title searches, attorney title opinions, commitments, acquisition packages and condemnation suits used in the acquisition of County properties and ensures County and legal requirements are met.</p> <p>Work is performed with independence under the supervision of the Title Program Manager and is reviewed for compliance with division objectives and policies for achievement of desired results.</p> <p>Representative Duties/Assignments:</p> <p>Duties may vary based on area of assignment. The following are representative duties, it is not the intent to capture all duties performed by this classification.</p> <p>Reviews and examines title, conducts research from multiple sources, identifies title defects, determines information necessary to clear title and provides explanation of title information to title examiners, acquisition agents, property owners, attorneys, and developers.</p> <p>Conducts preliminary due diligence and research for properties to be acquired by the County to identify potential challenges and coordinates with acquisition agents and assists leadership to strategize negotiations and effectuate action plans.</p> <p>Reviews legal descriptions, right-of-way maps and construction and development plans.</p> <p>Maps out metes and bounds legal descriptions using online tools to determine if there are any overlapping conflicts for real property interests to be acquired by the County.</p> <p>Reviews title exceptions and encumbrances to determine the appropriate clearing mechanism prior to closing.</p> <p>Prepares and reviews instruments of conveyance and related documents for proper form, accuracy and completeness.</p> <p>Reviews complex real estate agreements and provides recommendations as to real estate matters to developers, attorneys, engineers, and other County departments.</p> <p>Uses advanced technical and analytical skills to retrieve information to locate owners of property who are not of record or who do not know that they may have any interest in property cited for acquisition.</p> <p>Prepares informative request for review memos for submission to the County Attorney¿s Office and/or Risk Management which articulate the background and context of certain projects to facilitate their review, approvals, and or opinion regarding a specific document or question.</p> <p>Contacts property owners and others having an interest in parcels to be condemned to verify information for service of process and suit filing.</p> <p>Prepares condemnation suit packages for filing by the County Attorney's Office.</p> <p>Participates in pre-order of taking meetings and testifies in court hearings as to title matters.</p> <p>Tracks all assigned projects through the Division's project management software.</p> <p>Reviews legal documents items submitted for real property and leasehold acquisitions for completeness and accuracy and processes them for approval as Board of County Commissioners agenda items or under Ordinance.</p> <p>Coordinates closings with title companies and/or attorneys and reviews all closing documents for completeness and accuracy.</p> <p>Provides assistance to other staff in complex transactional matters.</p> <p>Performs other related duties as required.</p> <p>Minimum Qualifications:</p> <p>Bachelor's degree from an accredited institution and five years of professional experience in title research and examination of real estate or an equivalent combination of relevant education and experience.
