PREVIOUS APPLICANTS ARE STILL UNDER CONSIDERATION AND DO NOT NEED TO REAPPLY.* </li><li>Only current North Carolina State Government employees or former RIF employees, eligible for priority re-employment consideration as described by General Statute 126, are eligible for consideration for this position.* </li></ul> <p>This position currently qualifies for a telework option.</p> <p>Telework options are subject to change at the discretion of management.</p> <p>The Mission of the Department of Public Instruction: </p> <p>The North Carolina Department of Public Instruction (NCDPI) is charged with implementing the state's public school laws for pre-kindergarten through 12th grade public schools at the direction of the State Superintendent of Public Instruction and State Board of Education.</p> <p>The North Carolina Department of Public Instruction is seeking applicants for an Agency HR Consultant III (Employee Relations & EEO Consultant) for our Human Resources section. </p> <p>The Human Resources Division provides a range of services for the employees of the Department of Public Instruction. The Division ensures compliance with Federal and State law, and guides agency leadership, management, supervisors, and employees in the areas of: human resources administration and policy interpretation, classification and compensation, employee relations/disciplinary policy and procedures, EEO administration, grievance administration, recruitment and selection, salary administration, BEACON/IHRP administration, performance management, workforce development/talent management, benefits administration, time and leave management, temporary position management, and HR records management. The Human Resources Division also provides HR consultation and policy interpretation for Educator positions that are subject to NC General Statute 115C.</p> <p> </p> <p>This position is a member of the agency's HR leadership team and participates in a collaborative manner to improve process and operations across all HR disciplines. The position is responsible for leading and coordinating an effective employee relations program consistent with state policy and practice. The position reviews disciplinary action and performance management documents, provides consultation to management and employees regarding all aspects of employee relations and related policies and procedures, reviews policy and writes procedures and work instructions for areas of assignment (ER and EEO) and may present/lead HR training. The position serves as the primary Agency Grievance Coordinator and will coordinate and process grievance filings timely. This position also serves as the Agency EEO Officer and is responsible for promoting and supporting workplace equal employment opportunity initiatives and collaborating with department leadership to continuously assess diversity and inclusion needs and opportunities. This includes development of the agency's annual EEO Plan. In addition, the position serves as lead investigator for EEO Informal Inquiries and employee complaints involving allegations of Unlawful Workplace Harassment, discrimination and/or retaliation. This position reports to the HR Director and represents the HR Director's employee services initiatives and participates in division-wide and/or state-wide projects as requested.</p> <p>This position key responsibilities are, but not limited to:</p> <ul> <li> <p>Provide consultation to DPI employees and managers addressing all levels of disciplinary action and review all levels of disciplinary actions to ensure consistent compliance and administration of the discipline policies and processes department-wide. </p> </li><li> <p>Explain all relevant laws, procedures, directives, and guidelines which impact options in dealing with employee relations matters to employees, supervisors, and managers throughout the organization. </p> </li><li> <p>Position will be required to make site visits to the work units and conduct internal investigations of employee and management reported issues. </p> </li><li> <p>Responsibilities include developing the investigatory methodology - such as who should participate in the investigation, what interim action is required and who should be interviewed - and conducting the interviews of the complainant and witnesses. </p> </li><li> <p>Analyze the evidence as it applies to law, regulations, policies and procedures, and prepare a summary of the investigation with recommendations to supervisor for the appropriate course of action, including the level of discipline. </p> </li><li> <p>Coordinate the agency's Grievance and Mediation Process with the Office of State Human Resources and oversee adherence to all policy timelines, as well as consult with the HR Director.</p> </li><li> <p>As the EEO Officer, consults with all levels of management on an ongoing basis to establish priorities and develop the annual Equal Employment Opportunity Plan for the agency. </p> </li><li> <p>Acts as a liaison with the Agency General Counsel and the Attorney General's Office in developing resolution to EEO cases heard before the Office of Administrative Hearings; reviewing evidential documentation to determine if discrimination occurred and recommend an appropriate course of action. </p> </li><li> <p>Conducts EEO investigations, develops written report of findings and recommendations, and collaborates with the Learning Management System (LMS) Administrator to monitor the mandatory participation of managers and supervisors in the Employment Opportunity and Diversity of Fundamentals (EEODF) training sponsored by the Office of State Human Resources. </p> </li><li> <p>Works closely with OSHR EEO office to obtain updates on best practices and develop on-going EEO training for managers and supervisors. Develop written responses to Requests for Information on employee filings of charges and grievances to the EEOC and OAH.</p> </li><li> <p>Provides oversight of benefits administration to include family medical leave and other leave of absence situations, disability, workers compensation, American with Disabilities Act (ADA) accommodation requests, retirement, and annual employee benefit enrollment.</p> </li><li> <p>Provides guidance and leadership to the human resource management team; assists with resolution of issues related to employee relations, EEO, and benefits administration concerns, questions, or issues.</p> </li></ul> <p>Other duties as assigned.</p> <p>Note: To receive credit for your work history and credentials, you must list the information on the State of North Carolina application in the Education and Work Experience sections of the application form.
